Estate Brandy Scheme

17. Requirements relating to labels

(1)Only labels approved by the Authority for this purpose shall be affixed to containers of estate brandy.

 

(2)An application for an approval referred to in subsection (1) shall be accompanied by three specimens of each of the labels concerned.

 

(3)Such application shall be approved only if the Authority is satisfied that—
(a)the applicable particulars required by the Act are indicated on the labels concerned in the manner required by the Act;
(b)the name under which the estate concerned is defined, and the expression "estate" or "landgoed" are indicated on the main label concerned in the manner set out in subsection (4); and
(c)any other word, expression, illustration or depiction indicated on the labels concerned—
(i)does not qualify the certification of the estate brandy concerned or is in conflict with such certification;
(ii)is not derogatory, inaccurate, untrue or vague with regard to the certification of the estate brandy concerned or with regard to brandy in general; and
(iii)is not indicated in such a manner that it constitutes a contravention of section 12 of the Act.

 

(4)

(a)The particulars referred to in subsection (3)(b) shall be indicated on a label in such a manner that it is clearly evident that the expression "estate" or "landgoed" relates to the defined name of the estate concerned.
(b)The particulars referred to in subsection (3)(b) shall be indicated in letters and figures—
(i)that appear on a uniform and clearly contrasting background;
(ii)that are clearly legible;
(iii)that are printed indelibly; and
(iv)of which the minimum vertical height, in the case of a label with area as specified in column 1 of the table hereunder, is as specified in column 2 of the said table opposite thereto:

(c)For the purposes of paragraph (b)(iv) the area of a label that is not square or rectangular shall be calculated by multiplying the maximum vertical height thereof with the maximum horizontal width thereof.
